Podcast Strategy Review Customer Agreement

This Customer Agreement applies when you purchase a Podcast Strategy Review from Shaleen Farrell, ABN 30453778101 (“I”, “me” or “my”).

By purchasing the service, you confirm that you have read and agreed to this Agreement.

1. What you’re purchasing

The Podcast Strategy Review is a personalised review of your podcast, built around information you provide about your show, audience and goals, as well as one episode of your choice.

Your review includes:

  • review of one podcast episode up to 60 minutes;

  • review of relevant aspects of your podcast positioning and packaging;

  • feedback on areas such as episode structure, opening, pacing, hosting, titles and other parts of the show where relevant;

  • personalised recommendations and examples;

  • recommendations or experiments I think are worth testing;

  • guidance on how relevant feedback could be applied to future episodes;

  • priority action items;

  • a written PDF report; and

  • a feedback video walking you through the review.

Because the review is personalised, the exact amount of time and space spent on each area will depend on what I find in your podcast. Not every review will cover every possible area in the same level of detail.

The service does not include podcast editing, production, implementation of recommendations, ongoing consulting or additional episode reviews unless these are specifically included in your order.

2. Additional episodes

If you purchase an Additional Episode add-on, I will review one additional episode of up to 60 minutes as part of the same Podcast Strategy Review.

The additional episode is an add-on to the Podcast Strategy Review and is not offered as a standalone service.

If an episode is longer than 60 minutes, I may ask you to nominate the 60-minute portion you would most like reviewed or discuss another option with you before beginning.

3. Your intake form

After purchasing, you will receive a link to an intake form.

You’ll be asked to provide information such as:

  • your name and email address;

  • your podcast and episode link;

  • who you want the podcast to reach;

  • what you want the podcast to help you achieve; and

  • anything in particular you would like me to pay attention to.

The review is based partly on the information you give me, so please provide information that is accurate and as complete as reasonably possible.

You are responsible for making sure any links, files or materials you send me are accessible.

4. When the turnaround time starts

The standard turnaround time is 7 working days.

This starts once:

  1. your purchase has been successfully completed;

  2. your intake form has been submitted; and

  3. I have received everything I reasonably need to begin the review.

If information or materials are missing, the turnaround period will not begin until I have received them.

If I need clarification while working on the review, I may contact you. If I cannot continue without your response, the delivery date may move accordingly.

If I expect a delay on my side, I’ll let you know as soon as reasonably possible and give you an updated delivery date.

5. Changing your episode or scope

If you want to change the episode you submitted, contact me as soon as possible.

If I haven’t begun reviewing it yet, I will generally be able to swap it.

Once I have started reviewing an episode, changing to a different episode may require an additional purchase or fee because work has already begun.

Any work requested outside the scope of the Podcast Strategy Review will need to be agreed separately.

6. Payment

Payment is required at the time of purchase.

The price and currency that apply to your order are the ones shown at checkout when you purchase.

Optional add-ons are charged at the price shown when you add them to your order.

Any currency conversion fees or other charges imposed by your bank, card provider or payment provider are outside my control.

7. Cancellations and change of mind

If you change your mind before I have started working on your review, contact me as soon as possible. I can cancel the service and refund the amount paid.

Once work on your review has begun, a change-of-mind refund is not automatically available. If you decide to cancel after work has started, please contact me and I’ll let you know what work has already been completed and whether any refund for the remaining work is appropriate.

If I am unable to provide the service you purchased, I will offer an appropriate solution, which may include rescheduling or refunding the part of the service that cannot be provided.

Nothing in this Agreement excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

Australian consumer guarantees require services to be provided with due care and skill, to be fit for an applicable stated purpose, and within the agreed or otherwise reasonable time. Businesses do not generally have to provide a refund purely because a customer changes their mind.

8. What the review can and can’t guarantee

The Podcast Strategy Review is based on my professional judgement and analysis of the podcast, episode and information available to me at the time of the review.

Podcast performance is affected by many things outside my control, including your audience, publishing schedule, implementation, platform algorithms, competition, distribution and changes made by third-party platforms.

I therefore cannot guarantee any particular result from the review, including:

  • increases in listeners or downloads;

  • audience growth;

  • social media reach or engagement;

  • search or platform rankings;

  • revenue;

  • sponsorships;

  • guest bookings; or

  • any other particular business or podcast outcome.

You remain responsible for deciding which recommendations you want to implement and how you use the feedback.

9. Questions or corrections after delivery

If something in your completed review is unclear, or you believe I have misunderstood a factual detail about your podcast, you can email me within 7 days of delivery and I’ll reasonably clarify or correct it.

This does not include a new review, analysis of additional episodes, substantial new recommendations, rewrites or ongoing consulting unless we separately agree to that work.

10. Your podcast and materials

You keep ownership of your podcast, recordings, branding, documents and any other materials you provide.

By sending materials to me, you confirm that you are allowed to share them with me for the purpose of providing the service.

Please do not send confidential information belonging to another person or business unless you have permission to do so.

11. Ownership of the review

I retain ownership of my underlying review methods, templates, frameworks, report design and other materials I created before or independently of your review.

Once you have paid for the service, you may use the completed review and its recommendations for your own podcast and business.

You may also share the review privately with people who work directly on your podcast, such as your co-host, producer, editor or team.

You may not:

  • resell the review;

  • sell or distribute my templates or frameworks;

  • present the review or its contents as work created by you;

  • publish the full report publicly; or

  • commercially reproduce or redistribute substantial parts of it

without my permission.

12. Confidentiality and public use

I may need to access information about your podcast, audience, analytics, goals or business in order to complete the review.

I will not publicly share your non-public client information, analytics, completed review, strategy recommendations or other private materials without your permission, unless required by law.

I will also ask for your permission before using:

  • your podcast as a public case study;

  • screenshots or extracts from your review;

  • your feedback as a testimonial; or

  • your name or podcast name in promotional material relating to the service.

This does not prevent me from viewing or referring to material you have already made publicly available where reasonably necessary to provide the service.

Personal information is also handled in accordance with my Privacy Policy.

13. Third-party platforms

I use third-party services to run and deliver the Podcast Strategy Review, including services for payments, client intake, document creation, email and video delivery.

These may include Squarespace, Notion, Canva and the video platform used to deliver your feedback.

Their handling of personal information is addressed further in my Privacy Policy.

If a third-party platform has a temporary outage or technical problem that affects delivery, I will take reasonable steps to use another method or provide an updated delivery time.

14. Consumer rights

Nothing in this Agreement is intended to exclude or limit a right, guarantee or remedy that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.

Where there is a problem with the service, your rights and any available remedy will depend on the circumstances and applicable consumer law.

Because this is a standard-form customer agreement, it is also worth avoiding one-sided clauses that go further than reasonably necessary; Australian law prohibits unfair terms in consumer and qualifying small-business standard-form contracts.

15. Governing law

This Agreement is governed by the laws of Victoria, Australia and the laws of Australia that apply there.

Nothing in this section removes any mandatory rights you may have under consumer laws that apply to you.
